1. About these terms
These Terms & Conditions apply to the Photos Revived website at photosrevived.com and www.photosrevived.com, operated by FluentFlow LLC, based in Bingham Farms, Michigan, United States ("Photos Revived," "we," "us," or "our"). Questions and notices can be sent to hello@photosrevived.com.
These terms describe the conditions on which we make the website available. Where a legally binding agreement requires affirmative acceptance, we will request that acceptance at the relevant step. Visiting a preview or reading these terms does not authorize a payment or subscription. If you do not accept the conditions applicable to your use, please stop using the website.
Our Privacy Policy explains information handling. It is not a substitute for any separate consent required by law. Non-waivable consumer and privacy rights remain in force regardless of these terms.
2. Current preview and future availability
Accounts, photo uploads, AI restoration, stored galleries, sharing links, credit purchases, and subscriptions are not currently enabled. Images and plan descriptions demonstrate proposed features. No purchase is created by opening a plan description.
We may change or discontinue preview features. Displayed prices, storage amounts, completion times, and credit allowances are proposals, not a promise that a particular plan or feature will launch. The website is not presently accepting orders.
The sections below describing accounts, user photos, sharing, and paid services apply only if and when those features are made available under the then-current terms and necessary acceptance flow. Before launch, we will update applicable details. Nothing here promises that a feature is working now.
3. Eligibility and account responsibilities
The service is intended for people who are at least 18 and have legal capacity to enter an agreement where they live. If acting for a business or another person, you must have authority to do so.
When accounts become available, provide accurate information, keep login credentials secure, and notify us promptly if you suspect unauthorized access. You are responsible for your authorized use of your account; you are not automatically responsible for activity caused by our own security failure or for liability that applicable law does not permit us to assign to you. Do not impersonate someone else, sell access, or bypass account restrictions.
4. Your photos, permissions, and ownership
You retain the rights you have in your original photos and other material you submit. We do not acquire ownership of your family photographs simply by processing or storing them. Possessing a printed photo does not necessarily mean you own its copyright; obtain the rights or other lawful basis needed to reproduce, edit, upload, and share it.
When uploads are enabled, you are responsible for having the permissions required for the material and the people it depicts, and for information you add about others. Consider privacy, publicity, copyright, and any confidentiality restrictions, especially for photographs of children or sensitive family circumstances.
For content you choose to submit to an enabled feature, you grant us a non-exclusive, limited permission to host, copy, transmit, process, transform, and display that content only as needed to deliver the feature you request, maintain its security, and comply with law. We may permit the service providers necessary to deliver that feature to do the same for those purposes. This permission does not allow us to sell your photos, use them in advertising, or train AI models on them.
The permission lasts only as long as needed for those purposes, including applicable backup, deletion, and legal-retention periods explained in the Privacy Policy. It does not undo copies you have already chosen to share with others. We will ask separately before using your identifiable content in testimonials, marketing, or public examples.
As between you and us, you retain your rights in input content and, to the extent we obtain transferable rights in a restoration, those rights are assigned to you upon creation. This does not guarantee that AI-generated elements are copyrightable, unique, or free of third-party rights.
5. AI restoration and its limitations
AI restoration, when enabled, will use an external processing service identified in the Privacy Policy and relevant feature notices. The selected photo and necessary instructions will be transmitted for that purpose. Do not submit material that you are not permitted to send to such a service.
AI may reconstruct or invent color, texture, facial details, objects, lettering, or background features. Even a prompt asking the system to preserve every detail cannot guarantee an exact likeness or faithful historical reconstruction. Closed eyes, expressions, clothing, faces, and small objects may change. Inspect the result and compare it with your original before keeping or sharing it.
Restorations are interpretations, not authenticated historical records, forensic evidence, identity verification, or proof of an event. Do not present a materially altered image as an unaltered original in a way that deceives others. Descriptions such as “HD” or “4K” do not guarantee that missing source detail can be recovered; actual output dimensions and quality depend on the source and the available feature.
Processing times are estimates. Demand, provider limits, network conditions, and the source image can affect completion. We may reject content or requests that violate law, these terms, or applicable provider restrictions communicated for the feature.
6. Galleries, sharing, downloads, and backups
When galleries and sharing are available, you decide which material to include and who receives it. Follow the access controls shown in the product. A link-based gallery may be accessible to anyone who possesses the link, and recipients may forward it. Do not assume that a sharing link verifies a person’s identity or prevents screenshots or downloads.
Turning off a link, removing a photo, or closing an account cannot recall copies that recipients already downloaded, saved, or shared elsewhere. Third-party messaging, social-media, and storage services have their own terms and privacy practices.
Keep your own copies of important originals and downloaded restorations. The service is not a substitute for an independent archive. Future storage allowances, export options, inactivity rules, and deletion periods will be disclosed before the relevant feature is enabled. We do not currently offer permanent or unlimited storage.
7. Acceptable use
You must not use the website or any enabled feature to:
- Violate law or infringe another person’s copyright, privacy, publicity, or other rights.
- Upload unlawful sexual content, child sexual abuse material, non-consensual intimate images, or content used to exploit, threaten, or harass someone.
- Create deceptive impersonations, commit fraud, or falsely represent an altered photograph as evidence or an authentic identity document.
- Upload malicious files, attempt unauthorized access, probe private galleries, bypass security or billing controls, or misuse sharing tokens or credentials.
- Use automation to overload the service, evade usage limits, resell access without permission, or systematically collect other users’ content.
These restrictions do not prohibit activity that applicable law expressly protects. If you identify a security issue, report it privately to hello@photosrevived.com without accessing other users’ information or disrupting the service.
8. Future purchases, credits, renewals, and refunds
No payments or subscriptions are active on this website today. Proposed prices are shown in U.S. dollars unless otherwise labeled and may change before launch. Browsing, previewing a plan, or emailing us does not create a payment obligation.
Before enabling a purchase, we will disclose the actual price, taxes where applicable, included credits and storage, when credits are used, any expiration or rollover terms, renewal frequency, cancellation method, and applicable refund terms. You will have an opportunity to review and explicitly authorize the purchase. A recurring payment requires your separate informed authorization; we will not enroll you automatically from the preview.
If subscriptions launch, the checkout and account controls must state how to stop future renewals and when cancellation takes effect. Any price change for an existing subscription will require the notice and any consent required by applicable law. Cancelling a renewal is different from deleting an account or withdrawing a privacy consent.
Future credit rules will explain how failed or interrupted jobs are treated. The proposed “one photo, one credit” model does not currently debit any balance. No fixed credit-expiration, refund-exclusion, or storage-forfeiture rule is imposed by this preview. We will disclose those details before selling the corresponding service.
Nothing in these terms removes statutory refund, withdrawal, cancellation, warranty, or charge-dispute rights. Contact hello@photosrevived.com if you believe you were charged in connection with this preview; do not send full payment-card details. Purchases through a future iOS app may be subject to Apple’s billing and refund procedures, which will be explained in the app.
9. Website materials and feedback
The website’s design, software, branding, and materials are owned by us or used under appropriate rights, except for user content and third-party materials belonging to their respective owners. You may view and use the website for its intended purpose. These terms do not grant a general right to copy our branding, redistribute the software, or reuse demonstration images outside the site; any separately stated license still applies.
If you voluntarily send suggestions, you permit us to consider and use the suggestions without an obligation to compensate you. This permission does not transfer ownership of your photos or permit disclosure of personal information contrary to the Privacy Policy. Please do not send confidential business ideas you expect us to protect under a separate agreement.
10. Content complaints and removal requests
Send copyright, privacy, or other content concerns to hello@photosrevived.com. Identify the relevant page or content, explain the right or concern, and provide a way to contact you. Include only information necessary to assess the request. We may ask for proportionate evidence of ownership or authority and will review reports under applicable law.
If a formal legal notice is needed, it must satisfy the applicable legal requirements. This general contact route is not a representation that we have registered a designated copyright agent or that sending a message automatically constitutes a valid statutory notice. Knowingly submitting false reports may have legal consequences.
11. Suspension, discontinuation, and changes
We may restrict access where reasonably necessary to address unlawful use, a material breach, a security threat, or a legal requirement. Where appropriate and lawful, we will explain the restriction and provide an opportunity to resolve it. Urgent security or legal circumstances may require action without advance notice.
We may update or discontinue the free preview. Any future paid service will be subject to its applicable agreement and mandatory consumer rights; preview status does not give us a right to keep payment for a service we are legally required to refund.
We may revise these terms and will update the effective date. Material changes will be brought to your attention through a prominent notice and any other legally required method. Where renewed acceptance is required, we will request it. Changes will not retroactively reduce rights in completed purchases or resolve an existing dispute on new terms without lawful agreement.
12. Disclaimers and responsibility
To the extent permitted by applicable law, the free preview is provided “as is” and “as available.” We do not warrant uninterrupted operation, absence of errors, a particular launch date, or any particular restoration outcome. We disclaim implied warranties only to the extent the law permits us to do so. Links to independent websites do not make us responsible for their operation or content.
To the extent permitted by law, we are not responsible for losses caused by your unauthorized sharing, your misuse of an AI result, or interruptions outside our reasonable control. Neither party is liable under these terms for indirect or consequential losses that applicable law allows it to exclude. This does not exclude foreseeable losses or remedies that cannot lawfully be excluded for consumers.
Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence where such limitation is prohibited, death or personal injury caused by negligence where applicable, breach of mandatory data-protection obligations, or any other liability that cannot lawfully be excluded or limited. These terms do not impose a blanket indemnity, mandatory arbitration, or a waiver of class-action or small-claims rights.
13. Disputes and general provisions
If an issue arises, you may contact hello@photosrevived.com and we will try to resolve it. This informal route is voluntary and does not prevent you from contacting a regulator, seeking urgent relief, or exercising a right within a legal deadline.
These terms are subject to applicable law, including mandatory protections where you live. They do not require you to use a distant court or waive an otherwise available forum. The law and court with jurisdiction will be determined under the applicable rules rather than an exclusive forum clause in these preview terms.
If a provision is unenforceable, it will apply only to the extent permitted and the remaining provisions will continue where legally possible. A failure to enforce a provision immediately is not a permanent waiver. These terms do not create an employment, agency, or partnership relationship. Any future transfer of the service must respect applicable law and the commitments in the Privacy Policy.
